Veterans Disability Benefits in Oregon

Oregon, known for its lush forests and stunning coastline, is proud to be the home to over 250,000 courageous veterans. As a gesture of respect for their selfless service, the Department of Veterans Affairs (VA) offers meaningful benefits to Oregon veterans.

One significant benefit is the Veterans Disability program. The program awards monthly financial compensation to eligible veterans with disabilities related to their military service.

Understanding VA Disability Ratings

To determine the level of a veteran's disability, the VA uses a rating system. Each condition is assigned a score that ranges from 10% to 100%. A higher score means the condition is more severe, and accordingly, the veteran is eligible for a larger monthly payment.

Veterans are typically required to participate in a Compensation & Pension (C&P) examination. The VA conducts this medical evaluation to assess the disability and assign it a rating.

If a veteran has multiple disabilities, each condition is rated separately using the VA's Schedule for Rating Disabilities. Then the VA uses a special formula to calculate the combined disability rating.

Eligibility Guidelines for VA Disability Benefits

To be considered eligible for VA benefits, Oregon veterans must meet several eligibility requirements.

Both of these must be true:

  • You have an existing condition, either physical or mental, that impacts your health, and
  • Your service history includes active duty, active duty for training, or inactive duty training.

And, at least one of the following must be true:

  • You incurred an injury or sickness during your military service that can be connected to your current condition. This is known as an in-service disability claim.

    or
  • An existing injury or illness from before your military service worsened due to your service — called a pre-service disability claim, or
  • You have a disability that is associated with your active-duty service but it only manifested after your service ended. This is known as a post-service disability claim.

The success of a VA disability claim largely relies on having medical evidence that directly ties your condition to your active military service. Keep detailed medical records during your military service to increase the possibility of receiving benefits.

Also, the way you separate from the military can determine your eligibility. If you were discharged honorably or under general conditions, you're typically able to get all the benefits from the Department of Veterans Affairs like health care, education assistance, and housing support.

But if you left the military with a less-than-honorable discharge, which is also known as a bad conduct or dishonorable discharge, you might be ineligible for VA benefits.

Applying for VA Disability in Oregon

Before applying for disability benefits, gather and arrange all necessary paperwork and medical evidence. Your military records, any medical reports, and your DD214 form that verifies your military service are all crucial. You can also include witness statements that help link your disability to your time on active duty.

When you're ready to apply, you can visit VA.gov. Click on "Sign in to start your application" and follow the instructions.

You can also choose to mail your application or apply at a VA office in person.

To apply by mail, download and fill out the Veterans Application for Compensation and/or Pension (VA Form 21-526EZ), and mail it to:

Department of Veterans Affairs
Claims Intake Center
PO Box 4444
Janesville, WI 53547-4444

To apply in person, visit your local Oregon VA office. A veterans service officer will be on hand to help answer any questions you may have.

Be aware that the processing times for a VA claim can vary — usually between 3-6 months or possibly longer. An approval may come faster if your claim has complete and accurate information.

Appealing a Denial

If your VA disability claim doesn't go through, don't worry — you can challenge the decision by filing an appeal. Fill out a Notice of Disagreement form and send it to the VA within a year from the date of the denial notice.

When submitting your Notice of Disagreement, attach your medical records, documents, and supporting statements that connect your disability to your time in the military. To win your appeal, you need to prove that your disability is real and directly related to your service in the military.
